EXCURSIONS TERMS AND CONDITIONS AGREEMENT

This agreement with Valencia Travel is available in Spanish as a courtesy. If there is any difference in meaning between the Spanish and English versions of this agreement or any related documents we provide you, either now or in the future, the English version is the official document and will prevail. Please consult with a translator if you have any questions.

We suggest you read this document carefully and print a copy for your reference. You may refer back to it at any time by accessing the Excursion Terms and Conditions tab within our website www.valencia-travel.com.

When reserving or participating in an Excursion and any related products or services (the “Excursion”) with Valencia Travel LLC, a United States of America company (“Valencia Travel” or the “Excursion Coordinator” or “we” or “us”), and you (“you”) the customer, agree to the Terms and Conditions Agreement ( “Terms” or “Agreement”).

By booking an excursion, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you make a reservation on behalf of other participants, you guarantee that you have the authority to accept and accept these Terms on behalf of the other participants in your group. When we send you an estimate or invoice with the terms of the excursion included, you, by returning it to us, are accepting these terms. If you request a copy of the terms to keep in your files, we will kindly send it to you in PDF format.

Reservation Agreement:

Your reservation is confirmed and there is a direct contract with the service provider / operator, when the Excursion Coordinator or the service provider / operator issues a written or online confirmation after receiving the full amount of the corresponding payment. Please check your confirmation and immediately report any incorrect or incomplete information to the Excursion Coordinator. Make sure the names are exactly as indicated in the corresponding passport.

You must be at least 18 years of age to make a reservation. You agree to provide complete, complete and accurate information to the Excursion Coordinator.

Acceptance:
A deposit for a booking constitutes Customer’s acceptance of these Terms & Conditions.

Excursion Deposit:
Excursions or Land bookings require a US$300 per person land deposit to hold reservations for the land excursion services. By making this non-refundable deposit, we guarantee that we can book in advance the land services like,  hotels, ground transfers, activities, guides, coordinate and meet all the other collaborators that we have reserved well in advance for the excursion. The Customer will be notified if a larger deposit is required should a Service Provider require additional deposits above the specified amount. Additional deposits are disbursed to suppliers upon receipt and cannot be recovered from Valencia Travel. Deposits are 100% non-refundable, no exceptions. Travel protection will cover deposits in most instances and Valencia Travel recommends Customers purchase travel protection to cover their deposit. Customers will be notified if a larger deposit is required at time of quoting.
Reservation on behalf of others:
When booking on behalf of other participants, you are considered the designated contact person for each participant included in that reservation. This means that you are responsible for making all payments due in connection with your Tour reservation, notifying the Excursion Coordinator or service provider if changes or cancellations are required and keeping your group information.

By booking on behalf of another person or persons, you represent and warrant that you have obtained all the required consents. You are responsible for verifying that any information you provide on behalf of another participant is complete and accurate, and the Excursion Coordinator will in no event be responsible for any errors or omissions in the information provided to complete a reservation.

Required Medical Information:

You should always consult with your physician and anyone else familiar with your medical history and needs before embarking on any tourism trip. Make sure you have confirmed with a medical professional that you are medically fit to embark on the trip you have booked. The Excursion Coordinator reserves the right to request further information or professional medical opinions when necessary, as determined in her discretion, for your safety or the safe operation of an excursion.

The Excursion Coordinator reserves the right to deny you permission to travel or participate in any aspect of a tour at any time and at your own risk and expense when the Excursion Coordinator determines that your physical or mental condition makes you unable to travel. or represents a danger to yourself or others.

Pregnancy is considered a medical condition and must be disclosed to the Excursion Coordinator at the time of booking. The Excursion Coordinator may refuse to bring pregnant women over 24 weeks. The Excursion Coordinator may refuse to transport anyone with certain medical conditions if accommodations cannot be arranged or other reasonable alternatives cannot be found.

In the event that you do not provide the medical information reasonably required by the Excursion Coordinator for any reason within the timeframe stated above, the Excursion Coordinator reserves the right to cancel your reservation and all applicable cancellation fees will apply.

You are responsible for evaluating whether an excursion is suitable for you. You should consult your physician to confirm your fitness to travel and participate in any planned activities. You should seek your doctor’s advice on vaccinations and medical precautions. The Excursion Coordinator does not provide medical advice. It is your responsibility to assess the risks and requirements of each aspect of the Tour based on your own circumstances, limitations, fitness level, and medical requirements.

Traveling with the Excursion Coordinator may involve visiting remote or developing regions, where medical care may not be easily accessible and medical facilities cannot meet the standards of those found in your home country. The condition of the medical facilities to be visited in the countries to be visited may vary and the Excursion Coordinator makes no representations and does not offer guarantees regarding the availability or standard of medical facilities in those regions.

Special Requirements:

Any special requirements must be disclosed to the Excursion Coordinator at the time of booking. The Excursion Coordinator will make all reasonable efforts to accommodate special requirements or requests, but this is not always possible given the nature of the destinations visited and the availability of options outside of a planned itinerary. Certain activities may be inaccessible to you if your mobility is limited in any way. All food allergies and dietary restrictions must be disclosed to the Excursion Coordinator at the time of booking, but the Excursion Coordinator cannot guarantee that he can meet dietary needs or restrictions. Any special request or requirement is not part of these Terms or the contract between you and the Excursion Coordinator and the Excursion Coordinator is not responsible for any failure to accommodate or fulfill the requests.

Age Requirements:

Anyone under the age of 18 on the date of the first trip is considered a minor. Minors must always be accompanied by an adult.

All reservations with a minor are subject to review and approval by the Excursion Coordinator. If applicable law requires the consent of a parent, guardian or any other person for a minor to travel, the accompanying adult is responsible for securing all consents, documentation and ensuring that they and the minor comply with all legal requirements for travel, to enter and exit applicable countries and regions. The Excursion Coordinator will not be responsible for any fees, damages, or losses incurred as a result of any failure to secure the necessary consents, permits, and approvals.

Each adult on a reservation with a minor or minor (s) is jointly and severally responsible for the behavior, well-being, supervision and monitoring of said minor (s), and jointly accepts these Terms for and on behalf of any minor (s) in their reservation, including all assumptions of risk and limitations of liability. The Excursion Coordinator does not provide care services for minors and expressly waives any responsibility to accompany or control minors.

Compulsory Insurance Requirement:

YOU MUST HAVE TRAVEL INSURANCE WITH MINIMUM MEDICAL, EVACUATION AND REPATRIATION COVERAGE that covers all applicable travel dates on the Excursion. This insurance should cover personal injury and emergency medical expenses. On the first day of each Excursion, a representative of the Service Provider / Operator will verify that you have sufficient insurance. It is strongly recommended to extend your coverage to include cancellation, reduction and all other expenses that may arise as a result of loss, damage, injury, delay or inconvenience during the trip. You acknowledge that insurance coverage is not included in the cost of any Excursion offered by the Excursion Coordinator and you must obtain separate coverage at an additional cost. It is your responsibility to ensure that you have sufficient coverage and comply with the terms of the applicable insurance plans. You are responsible for informing your insurer of the type of trip, destination (s) and activities included in your reservation so that the insurer can provide adequate coverage.

Prices, Surcharges and Taxes:

The Excursion Coordinator will not increase the price of your Tour after you have paid in full. The Tours have a determined and published price, including applicable taxes.

Changes:
Once a deposit has been received, a US$100 per booking change fee will apply. Other fees are at the discretion of the hotels, tour operators, rental car agencies and other Service Providers.

Final Payment and Acceptance of the reservation:
The confirmation sent by Valencia Travel will contain details of the final payment required for any reservation. Payment of the balance of the price of the reserved products or services must be paid in full 30 days before the departure date of the first product or service included in the corresponding reservation. If full payment is not received by the applicable due date, the Excursion Coordinator may, in his sole discretion, change the fee payable for the reservation or treat the reservation as canceled and retain the deposit paid on the reservation as a fee. cancellation. If the reservation is made less than 30 days prior to the departure date of the first product included in the corresponding reservation, the total amount must be paid at the time of reservation. If, for any reserved product or service, the payment terms differ from those described in this section, the applicable terms will be communicated prior to the reservation and will also be detailed on the corresponding invoice.

The Excursion Coordinator is not responsible for charges charged by third parties or financial institutions and that you must pay as a result of credit card or other payment transactions and will not refund or refund any fees charged by third parties or financial institutions in relation to payments made by you to the Excursion Coordinator. The Excursion Coordinator will charge a single rate of 4.5% when you make the payment of the services or deposit with a Credit or Debit Card.
In some cases, prices may be adjusted as described elsewhere in these Terms and Conditions.

Final Payment:

Final payment is due 30 days prior to departure unless early booking discounts or advance purchase rules apply.

Cancellations:

Cancellation penalties may vary depending on the products reserved. The cancellation fees are as follows:

  • Before final payment: loss of deposit.
  • After final payment: 100% of the total cost of the reservation.

Final payments are disbursed to service providers upon receipt and cannot be recovered from Valencia Travel. Final payment is non-refundable under any circumstances and travel protection is recommended to cover cancellation covering unforeseen circumstances. The hotels and services contracted by Valencia Travel may have their own cancellation fees. Such fees are in addition to cancellation fees imposed by Valencia Travel and may not always be disclosed by the hotel or service provider until the time of cancellation. All cancellation fees are the sole responsibility of the Client.
Airlines Tickets:
Valencia Travel LLC acts only as an intermediary with free assistance between you and the airline and will apply the terms and conditions of the airline to the purchase and use of the air travel ticket. Please see the applicable airline terms and conditions and conditions of carriage for complete information, including applicable cancellation terms. The Excursion Coordinator is not responsible for changes in air itineraries or flight times and does not provide advice or alerts on air tickets, flight status or delays.

Hotels/Accommodations:
Hotel rates may not include local taxes in some cities and resorts and shall be paid locally by the Customer. Valencia Travel does not guarantee specific bed types, air conditioning standards or availability, the absence of unexpected hotel repair or construction activity, or assignment of rooms which are the choice of the hotel management.

Mobility Requirements:

Requests for special accommodations and services to meet specific physical requirements must be made at the time of booking specifying the limits of mobility and description of mobility assistance equipment.  Such accommodations are subject to availability and cannot be guaranteed.

Late Bookings:

Any bookings made within 30 days of departure, regardless of value, will incur up to $300 late booking fee. This fee is to cover the cost of expediting the confirmation of your booking, covering price variations in airlines, hotels, service providers and processing final e-documents.

Documents:

Provided booking is paid in full 60 days prior to departure, documents will be sent electronically and expected to arrive via email within 4 weeks of departure. Customer is responsible to ensure that all arrangements are booked as requested and that the itinerary contains no errors. Valencia Travel, its agents, and representatives act as agents only for the purchaser of the packages in making arrangements for transportation, hotels and other services.

Prices:
Valencia Travel quotes prices in US currency based on the exchange rates for the respective foreign currency under, as of the date of the quote. Customer’s exchange rate is only guaranteed when full payment is made, unless otherwise noted on Customer’s itinerary. Any price that Valencia Travel quotes is subject to change without notice until full payment is made. The prices are per person and are quoted in a standard double room. For a person staying in a single room, there will be a surcharge that Valencia Travel will let the client know at the time of booking. For more than 2 people in a double room there will also be a surcharge that Valencia Travel will let the client know at the time of booking.

Children:
Please note that some travel products do not allow children below a certain age. If Customer plans to travel with children, Customer must notify Valencia Travel when booking and provide a clear copy of the passport photo page for each traveling child so Valencia Travel can verify ages.

Passports/Visas:
A passport valid for six months beyond the date of return travel is required for entry into Asian countries. Customers/Travelers should request information regarding any necessary visa requirements from the destination countries’ consulates or their travel agents.  Valencia Travel is not responsible for lost or stolen documents, and reissuance of documents may be assessed at their full-face value with a possible increase in cost.

Limitation of Liability:
Valencia Travel shall not be liable for any claims, losses, damages, costs, expenses, delays, sickness, injury, or loss of enjoyment, of any nature or kind whatsoever, resulting from events beyond Valencia Travel’ or a Service Provider’s reasonable control. In no event will Valencia Travel’ liability exceed the total amounts Customer paid Valencia Travel for Customer’s travel. Valencia Travel assumes no responsibility for lost tickets, documents, passes, or coupons.  Further, Valencia Travel shall not be liable for any injury, loss, claim, damage or any special, punitive, indirect, consequential, incidental damages of any kind, whether based on contract, tort, strict liability or otherwise, which may arise as a result of the use of Valencia Travel Travel Related Services and those of its Service Providers.

In the case of Force Majeure, an event beyond the control of the Customer and Service Provider, including: 

  1.     Act of God (including, but not limited to, fires, explosions, earthquakes, drought, tidal waves, and floods, riots, war, civil disturbance, strikes including strikes by Service Providers);
  2.     Plague, epidemic, pandemic, outbreaks of infectious disease or any other public health crisis, including quarantine or other employee restrictions; or
  3.     Government acts such as quarantine restrictions, travel bans, denial of entry, or personal history (e.g., court records or travel restrictions).

In the case of a Force Majeure, Valencia Travel shall not be liable for any claims nor be responsible for retrieving funds from the Service Provider on behalf of the Customer. Valencia Travel may, in its sole discretion, advocate on behalf of the Customer for the return of amounts paid and reserves the right to take any action that Valencia Travel deems appropriate under the circumstances.

In a Force Majeure event, if the Service Provider is prevented from carrying out its obligations, Valencia Travel will not be held accountable for retrieving funds and is entitled to keep no less than the deposit. In no circumstance will Valencia Travel’ liability exceed the total amounts the Customer paid.

Valencia Travel is deemed an independent contractor for all purposes under these Terms & Conditions. Valencia Travel acts solely for the facilitation and reservation of travel services and is not responsible for any fees held by the Supplier. If cancellation of travel falls within the non-refundable dates, Valencia Travel may not be held responsible to retrieve those funds.

Valencia Travel quotes in US currency. In the event of a refund due to a Force Majeure, the Customer will be responsible for any difference in rates due to currency fluctuations.

All current and future relationships with Valencia Travel should be undertaken with the utmost confidence that we will continuously work on behalf of our agents and clients to provide the most fulfilling experiences within the industry.

Relationship of the Parties:
Valencia Travel shall be deemed to be an independent contractor for all purposes under these Terms & Conditions. Valencia Travel is acting solely to facilitate the reservation and purchase of Travel Related Services and is not acting in any other capacity with either the Customers or the Service Providers, including, but not limited to, any partnership, joint venture, co-ownership, travel service provider or agency relationship of any kind with any Customer or Service Provider. Valencia Travel does not have any control over the quality, timing, safety, or legality of any Travel Related Service reserved or purchased by or for a Customer. Valencia Travel does not and cannot control whether a Service Provider represents its products accurately or fulfills any agreement or obligation with any Customer.

Disputes and Indemnity:
As Valencia Travel is not involved in providing the Travel Related Services for the Customer, any and all disputes between a Customer and Service Provider are solely between that Customer and that Service Provider, and the Customer and Service Provider should handle all such disputes directly with that Customer or Service Provider. If the Service Provider or Customer contacts Valencia Travel relating to any dispute between the Customer or Service Provider, Valencia Travel may, in its sole discretion, facilitate dispute resolution and reserves the right to take any action that Valencia Travel deems appropriate under the circumstances. Customer agrees to release Valencia Travel and its agents and employees from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. Furthermore, Customer agrees to indemnify, defend, and hold harmless Valencia Travel from any liability, loss, claim and expense, including reasonable attorney’s fees, arising out of or in any way connected with such disputes including on any appeal. Any dispute or claim shall be resolved exclusively by binding arbitration before a single arbitrator using the rules of the Judicial Arbitration & Mediation Service sitting in Orange County, Florida. The laws of Florida USA shall apply to these Terms and Conditions.  The prevailing party in any such arbitration or legal suit shall be entitled to all costs and reasonable attorneys’ fees.

Validity:

All prices are subject to change and are based on availability.

All Tour dates, itineraries and prices are subject to change at any time and the current price will be quoted and confirmed at the time of booking, subject to any surcharges that may be met in accordance with these Terms.
You acknowledge that you are responsible for keeping up-to-date on the specific details of your Tour and any other product or service, including, but not limited to, monitoring of the Excursion Coordinator or Service or Product Provider’s website. These Terms & Conditions are valid until further notice in writing from Valencia Travel.
