EXCURSIONS TERMS AND CONDITIONS AGREEMENT

IMPORTANT: This English version is the official governing version. Any Spanish translation is provided only as a courtesy. By submitting payment, deposit, written approval, or traveler information, the client and/or group leader acknowledges review and acceptance of these Terms and Conditions.
1. Parties and Role of Valencia Travel LLC
These Terms and Conditions are entered into by and between Valencia Travel LLC, a Florida limited liability company (the “Company,” “Valencia Travel,” “we,” “us,” or “our”), and the client, traveler, group leader, payer, or authorized representative (collectively, “Client,” “Traveler,” or “Group Leader”). Valencia Travel LLC acts as a travel coordinator, planner, intermediary, and booking facilitator for travel services supplied by independent third-party providers.
Valencia Travel LLC is not the owner, operator, manager, or direct provider of airlines, hotels, buses, vans, drivers, tour operators, restaurants, attractions, venues, boats, activities, guides, medical services, governmental authorities, or other third-party services in Colombia, Latin America, the United States, or any other destination.
2. Scope of Services and Third-Party Suppliers
Travel arrangements may include, without limitation, itinerary planning, group coordination, destination consulting, reservations, deposits, payment collection, communication with suppliers, ground transportation coordination, lodging arrangements, excursions, guided activities, and related travel logistics.
All such services are subject to the terms, conditions, schedules, safety rules, operational decisions, cancellation rules, and availability of the applicable third-party suppliers. Client understands that Valencia Travel LLC cannot control supplier performance, pricing, staffing, substitutions, delays, cancellations, mechanical issues, road closures, weather, security conditions, governmental restrictions, airport operations, or destination-level circumstances.
3. Group Leader Authority and Responsibility
When a trip is organized for a group, the person identified as Group Leader is acting as the authorized representative of the group. The Group Leader confirms that they have authority to communicate decisions, approve itinerary details, accept pricing, submit traveler information, collect or coordinate payments, and transmit notices on behalf of the group.
The Group Leader must provide their full legal name exactly as it appears on their passport or government-issued identification. Valencia Travel LLC may rely on instructions, confirmations, approvals, and representations made by the Group Leader as binding on the group, unless written notice to the contrary is received before any reservation or payment commitment is made.
4. Traveler Names, Passport Match, and Documentation
Each traveler is solely responsible for providing their full legal name exactly as it appears on their passport or government-issued identification, together with accurate dates of birth, passport numbers, expiration dates, contact information, and any other required travel data.
Valencia Travel LLC is not liable for denied boarding, ticket reissue fees, supplier penalties, immigration issues, or travel disruption caused by incorrect, incomplete, late, or inconsistent traveler information. Passport validity, visas, entry requirements, vaccinations, legal permissions, and travel documentation are the sole responsibility of each traveler.
5. Pricing, Airfare Volatility, and Quote Changes
The quoted price and attached itinerary are based on the information, availability, supplier pricing, exchange rates, transportation costs, hotel rates, airfare, taxes, and operational assumptions available at the time of quotation. Client acknowledges that airfare and supplier pricing can change without notice until reservations are fully confirmed and paid according to supplier requirements.
Client further acknowledges that Valencia Travel LLC explained during the telephone conversation that airline ticket prices and other supplier costs may change, and Client agreed to proceed with this understanding. Any increase in airfare, taxes, fuel surcharges, supplier rates, foreign exchange fluctuation, itinerary change, group-size change, or traveler-requested modification may increase the final price.
6. Deposits, Payments, and Reservation Confirmation
Reservations are not confirmed until required deposits, passenger information, and supplier approvals have been received and processed. Unless otherwise stated in writing, deposits and payments may be non-refundable once submitted to suppliers or once administrative work has begun.
For Zelle deposits or payments, Client may use: 4078647928 – Valencia Travel. Client is responsible for ensuring that payment is sent to the correct recipient and for including the traveler or group name in the payment memo when possible.
7. Cancellations, Changes, and Refunds
Cancellation, modification, substitution, and refund rights are governed by supplier rules and by written trip-specific terms. Valencia Travel LLC may charge administrative, planning, coordination, or cancellation fees separate from any supplier penalties.
No refund is guaranteed unless confirmed in writing by Valencia Travel LLC after supplier policies and recoverable amounts have been verified. Refund processing times depend on third-party suppliers and financial institutions.
8. Ground Transportation and Operational Liability Disclaimer
Ground transportation may be provided by independent transportation companies, drivers, vehicle owners, buses, vans, taxis, ride-share services, boats, or other local providers. Valencia Travel LLC does not own, operate, maintain, inspect, insure, supervise, or control such vehicles or drivers unless expressly stated in writing.
Client understands that road conditions, traffic, driving practices, security conditions, mechanical issues, weather, delays, and local operational decisions are outside the control of Valencia Travel LLC. Valencia Travel LLC is not liable for injuries, losses, delays, accidents, route changes, baggage issues, or damages arising from third-party transportation providers.
9. Company Coordinator Presence
The presence of a Valencia Travel LLC coordinator, host, escort, representative, or group assistant during any portion of the trip is intended to support communication and coordination only. Such presence does not convert Valencia Travel LLC into the operator, insurer, safety supervisor, transportation provider, hotel operator, medical provider, or legal guarantor of any third-party service.
Client agrees that operational decisions made by suppliers, drivers, hotels, venues, guides, airlines, government authorities, or emergency personnel remain the responsibility of those parties.
10. Travel Insurance Mandatory
Travel insurance is mandatory for participation unless Valencia Travel LLC provides a written waiver. Each traveler is responsible for obtaining adequate coverage for trip cancellation, interruption, medical expenses, emergency evacuation, baggage, delays, accident, and supplier default where available.
Failure to purchase or maintain adequate travel insurance is the traveler’s sole responsibility. Valencia Travel LLC is not responsible for uninsured losses.
11. Assumption of Risk and Traveler Conduct
Travel involves inherent risks, including illness, injury, crime, political events, weather, road conditions, food or water issues, altitude, physical exertion, cultural differences, and unexpected changes. Client voluntarily assumes all ordinary and extraordinary risks associated with travel.
Travelers must act respectfully, follow safety instructions, comply with laws, observe supplier rules, and avoid conduct that endangers themselves or others. Valencia Travel LLC may remove or decline service to any traveler whose behavior disrupts the group, creates safety concerns, violates law, or harms the Company’s reputation, without refund of unrecoverable costs.
12. Limitation of Liability
To the fullest extent permitted by law, Valencia Travel LLC shall not be liable for indirect, consequential, incidental, punitive, special, emotional distress, lost opportunity, lost vacation enjoyment, or similar damages. Any direct liability of Valencia Travel LLC shall be limited to the amount of fees actually retained by Valencia Travel LLC for the specific service giving rise to the claim, excluding amounts paid or payable to third-party suppliers.
Valencia Travel LLC is not liable for acts, errors, omissions, negligence, insolvency, delays, cancellations, overbooking, accidents, injuries, losses, or failures of any third-party supplier.
13. Force Majeure
Valencia Travel LLC shall not be liable for delay, cancellation, substitution, interruption, or failure to perform caused by events beyond its reasonable control, including but not limited to weather, natural disasters, pandemics, epidemics, civil unrest, strikes, labor disputes, terrorism, crime, transportation disruption, supplier failure, governmental action, border closures, airport disruption, war, emergency conditions, or acts of God.
14. Disputes, Governing Law, and Arbitration
These Terms and Conditions are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute, claim, or controversy arising out of or relating to these Terms, any trip, any payment, any representation, or any services coordinated by Valencia Travel LLC shall first be addressed in good-faith written negotiation.
If not resolved, the dispute shall be submitted to binding arbitration in Orange County, Florida, unless Valencia Travel LLC elects to pursue collection of unpaid amounts in a court of competent jurisdiction. Client waives any right to class action, jury trial, or consolidated proceeding to the fullest extent permitted by law.
15. Entire Agreement and Acceptance
These Terms, together with any trip-specific quote, invoice, itinerary, payment schedule, written messages, and supplier terms, constitute the entire agreement between the parties. If any provision is held invalid, the remaining provisions remain enforceable.
Acceptance may occur by signature, electronic approval, written confirmation, payment, deposit, submission of traveler infomation, or participation in the trip.
